    ADVERTISEMENT FOR BIDS  

    Date:  May 26, 2010

    Notice is hereby given that the Owner, Town of Skiatook , will accept bids for the construction of the Osage Trail and Highway Improvements Project identified as Skiatook Central Park Restroom and located at Highway 20 and Locust..

    All bids must be in accordance with the Contract Documents prepared and issued by LandPlan Consultants, Inc. located at      1110 West 23rd Street . Tulsa , Oklahoma 74107 .  

    The following is a general description of the Project:

    Construct the Town of Skiatook Restroom within the Skiatook
     Central Park including pedestrian paving, lighting, utilities, and 
    all other related items.

    Bids will be accepted on a Unit Price basis, and when applicable, includes additive and/or deductive alternates.

    Bids will be received at Skiatook Municipal Building , 110 North Broadway, P.O. Box 399 in Skiatook , Oklahoma until 10:00 AM local time    June 29, 2010  .  Bids received after the above time and date will be rejected.

    All bids must include assurances that the following provisions will be complied with:

    1. Federal Labor Standards Provisions, US Department of Labor , 29 CFR5;

    2. Section 3 of the Housing and Urban Development Act of 1974, as amended; 12 U.S.C. 1701U, which requires that, to the greatest extent feasible, opportunities for training and employment be given lower-income residents of the project area and contracts for work in substantial part by persons residing in the area of the project;

    3. Section 109 of the Housing and Community Development Act of 1974, which assures that no person shall, on the grounds of race, color, natural origin or sex, be excluded from participation in, be denied the benefits of or be subjected to discrimination;

    4. Certification of Non-Segregated Facilities, which assures the bidder does not maintain or provide any segregated facilities;

    5. Equal Opportunity Provisions – Executive Order 11246, as amended, which assures non-discrimination;

    6. Minority Business Enterprise and Women Business Enterprise provisions which encourage minority-owned business and women-owned businesses to bid on the project;

    7. Assurances that surety companies executing bonds appear on the Treasury Department's list and are authorized to transact business in the State where the project is located.

    At the above time and date, bids that have been duly received will be opened and read aloud. The City will forward the opened bids to its Project Consultant, LandPlan Consultants, Inc., for evaluation, review and recommendation. A recommendation for the most successful bidder will then be presented to the Skiatook Council.

    A “Bid Bond” or other bid security in the amount of 5 percent of the bid amount must accompany the submitted bid.

    No bids may be withdrawn within a period of sixty (60) days after the date established for opening bids.

    The successful Bidder will be required to furnish a Performance Bond and a Payment Bond, each for 100 percent of the contract amount, as security for the faithful performance of the work and the payment of all bills and obligations arising from the performance of the work.

    Copies of Bidding Documents may be obtained in person after 8:00 a.m. local time on June 1, 2010 at LandPlan Consultants   1110 West 23rd Street , Tulsa , Oklahoma 74107 for a price of $20.00.  Bidding documents will be mailed upon receipt of a check in the amount of $40.00. No partial sets will be issued and no refund will be provided for sets that may be returned.  For bidding document sets contact Emily Elkins with LandPlan Consultants at 918/746-1340 .

    All bids, which shall include the costs for payment and performance bonds when required, shall remain binding on the Contractor for a period of 60 days after the bid date and time and the Owner reserves the right to accept any bid, bid alternate or any combination thereof, to reject any or all bids, or to waive any informalities in bids received where such acceptance, rejections, or waiver is considered to be in the best interest of the Owner.  All alternates requested on the bid form will be considered in the award of the Contract.

    The Sponsor hereby notifies all bidders that this contract is subject to applicable labor laws, nondiscrimination provisions, wage rate laws and other federal laws including the Fair Labor Standards Act of 1938.  The Work Hours Act of 1962 and Title VI of the Civil Rights Act of 1964 also apply.  The Davis Bacon-Bacon wage rate requirements and any associated verification processes will apply to this project.

    The established Disadvantage Business Enterprise utilization goal of the project is 10%.

    A mandatory pre bid meeting conference will be held at the Skiatook Municipal Building , 110 North Broadway in Skiatook , Oklahoma at 11:30 AM local time,  June 22, 2010.  Each Contractor shall be required to have a representative in attendance to bid the project.
